Amweta Healthtech Private Limited ("Amweta"), operating under the sub-brand "medmora," offers online medical teleconsultation services. These services are provided through medical practitioners ("Practitioners") under the terms and conditions outlined below.
This Agreement pertains to two categories of users:
1. Patients, their representatives, or affiliates seeking healthcare services, including searching for Practitioners through the website ("End-User," "you," or "User").
2. General users of the website or services ("you" or "User").
The Agreement covers online medical teleconsultation services provided by Amweta's Practitioners on the medmora platform ("Services"). These Services may evolve over time, subject to Amweta's discretion.
Amweta reserves the right to modify or terminate any part of the Agreement at its discretion and for any reason. It is advisable to periodically review the Agreement. Continued use of the Services post any modifications implies acceptance of the revised Agreement. If you disagree with any part of the Agreement, refrain from using the website or availing the services.
The Agreement adheres to Indian laws, including:
- Indian Contract Act, 1872
- Information Technology Act, 2000
- Telemedicine Guidelines under the Indian Medical Council (Professional Conduct, Etiquette, and Ethics Regulation, 2002)
"Consult" is a service provided by medmora, allowing Users to obtain medical consultation from registered Practitioners through the medmora platform. Practitioners are assigned by medmora's algorithm based on various factors, such as consultation request timing, health issues, etc. Users can also select Practitioners using search options. This service is collectively referred to as "Consult."
Users must adhere to the following terms:
- Practitioners are assigned through an algorithm or chosen via search options.
- Prescriptions provided are based on online consultations and may differ in-person.
- Users agree to responsibly use Practitioners' advice, considering ongoing treatments, medical history, etc.
- Consultations are not substitutes for physical examinations.
- Users acknowledge limitations of online consultations and assume related risks.
- Consultations do not replace immediate medical attention.
- Consultations are based on general Indian medical conditions and practices.
- Users are responsible for sharing information and documents.
- Restrictions apply to drug prescriptions.
- Users must not use abusive language with Practitioners.
- Users may share relevant images or videos if necessary.
- Communication with Practitioners should be limited to the platform.
- Users must promptly share requested documents or reports.
- A single paid consultation covers one User.
- Users must not influence Practitioners to prescribe restricted drugs.
- Users agree to provide accurate information and comply with laws.
- Users acknowledge that transaction jurisdiction is India and Practitioners are licensed to practice within India.
- Users indemnify Amweta against any claims arising from improper use.
- Payments are made through the platform's payment gateway at the User's discretion.
- Refund policies are outlined based on specific scenarios.
- Consult is not suitable for emergencies or serious illnesses requiring immediate physical consultation.
- Users are responsible for booking in-person consultations if recommended by Practitioners.
- Amweta reserves the right to suspend or terminate services and exercise legal remedies.
Amweta and its entities are not liable for direct, indirect, or consequential damages due to the use of the website, content, or services.
- If a provision is invalid, the remaining Agreement remains enforceable.
- Waivers must be in writing.
- The Agreement is governed by Indian law.
- Disputes are subject to the jurisdiction of courts in Dadra & Nagar Haveli.

The Company shares User’s Personal Information with the following third parties:

The Company uses an online payment gateway that is operated by third parties and the information that the User shares with the Company is transferred and shared with such third-party payment gateway operator. The said third party operator may also have access to the User’s online purchase history or other details of the User with respect to his transactions on the Website.
The Website has adequate security measures in place to protect the loss, misuse, and alteration of the information under the Company’s control. Once User’s information is in the possession of the Company, the Company adheres to security guidelines, protecting it against unauthorized access. However, no Website can fully eliminate security risks.
If the User suspects any unauthorized use of his account, the User must immediately notify the Company by sending an email to support@Medmora.com. The User shall indemnify and hold harmless the Company from any loss that may be suffered by the Company due to such unauthorized use of the User’s account or password.
The Company shall not be responsible for any breach of security or for any actions of any third parties or events that are beyond the Company’s reasonable control including but not limited to acts of government, computer hacking, unauthorised access to computer data and storage device, computer crashes, lockdown restrictions, breach of security and encryption, poor quality of internet service or telephone service of the User.
The Company retains Personal Information for as long as necessary to provide access to and use of the Website and Services, or for other essential purposes such as complying with legal obligations, resolving disputes, enforcing agreements and as long as processing and retaining such Personal Information is necessary and permitted by applicable law. Even if User’s Personal Information is deleted, it may exist on backup or archival media for audit, legal, tax or regulatory purposes.

For a better experience, while using our Service, you are required to provide the app with certain personally identifiable information, including PERMISSION REQUIRED TO SEND SMS, PERMISSION REQUIRED TO ACCESS YOUR CURRENT LOCATION, and PERMISSION REQUIRED TO ACCESS YOUR DEVICE'S SENSORS.
The app requires permission for sending SMS to alert your emergency contacts by sending SMS when you are in an emergency. The app requires permission to access your current location in order to send your current location to the emergency contacts when you are in an emergency. The app also requires permission to access your device's sensors to detect emergency situations and trigger lifesaving services and within Minutes all Emergency contacts and Life saving services will be triggered.
The information that the app requests will be retained on your device and is not collected by us in any way. We will only collect your information when you explicitly give us permission to do so.
Disclosure of Personal Information
We will only disclose your personal information to emergency services providers, including ambulance and medical response teams, when you are in an emergency situation and have explicitly given us permission to do so. We will not disclose your personal information to any other third party without your explicit consent, except in cases where we are required to do so by law.
We value your trust in providing the app with your Personal Information, thus we are striving to use commercially acceptable means of protecting it. Since the information that you provide to this app is stored locally on your device, it is not accessible by anyone, not even us. We ensure maximum security of your information that we use but are not responsible for any breach/theft of your Personal Information caused by any other application on your device or by any kind of cyber-attack.
Users can access, review and modify all information provided by them to the Company by logging into their accounts on the Website.
The Company may, if the User so chooses, send direct advertisement mailers to the User at the address given by the User, which could contain details of the products or services displayed on the Website.
